猟奇殺人犯にされた女（虎の女とイエロージャーナリズム）

名張毒ぶどう酒事件の再審が決定し、なんとも嬉しい限りです。かなり強引な捜査の犠牲になったのは、被疑者とされた人だけではなく、犯人を逮捕し無念を晴らせなかった被害者も同様だと思われます。冤罪といえば、私がいつも思い出すのがこの事件。以前アメリカで起こったある不幸な事件とそのことで人生を台無しにされ名誉回復も出来なった女性の話です。

虎の女またはトランク殺人者ことウィニー・ルース・ジャド（上の画像）事件は、アメリカという国とマスメディアを考える上ではずせない事件であると同時に、日本の阿部定事件が果たしたある種の役割を、担うハメになった不幸な事件であると思う。世が世ならば、こんな茶番じみた冤罪、起きるはずがない。いやそうであってほしい。

砂漠に囲まれた街、アリゾナ州フェニックス。
１９３１年１０月１６日金曜日、ウィニー・ルース・ジャドは、以前のルームメイトであり、同じ診療所に勤める親友、ヘドウィグ“サミー”サミュエルソンとアグネス・アン・ルロワ（共に評判の美人だった）を殺し、二人の死体をトランクに詰め（サミーはバラバラに切断して詰めた）、彼女の手荷物としてロサンジェルス行きの列車に載せる。荷物預け室に届けられた、引き取り手のないトランクからは嫌な臭いと赤黒い液体が垂れていた。不審に思った駅員があけ、事件は発覚。が、すでにウィニーは行方をくらましたあとだった。１０日ほどたって、彼女は警察に捕まる。

若く美しい女がこれまた美しい「親友達」（これは婉曲的に同性愛等をほのめかした当時の表現の一つ）へ行った残虐な犯行！とマスメディアはセンセーショナルに報道する。そして告訴。彼女は死刑判決をうけた。ウィニー・ルース・ジャドの事件を伝える大抵の物語は、ここで終わっている。また、この事件を伝えるいくつかの本の中には、彼女が“電気椅子に座り「二人の所に行けるから幸せ」と話した”などと見てきたようなことを書いている。残虐な女はどのような末路をたどったのだろうか。どのように悔い改めながら、あるいはどんな修羅場を演じて電気椅子の上で絶命したのか？

否。彼女は死なず、生き延びたのだ。

刑執行の７２時間前に心神喪失を申し立て、それが受け入れられ、悪名高いアリゾナ州立精神病院に３８年１１ヶ月２２日収容されていた。その間幾度となく脱走し、６年ほど、外で暮らしていたこともある。

６６歳になり、ようやく仮釈放された。彼女には様々名前がつく。いわく「虎の女」「同性愛殺人者」「冷血漢」「トランク殺人者」「アメリカ史上初めての猟奇殺人者」等々。だがここで一番問題なのは、それら勇ましい名前が全て、彼女にはふさわしくない、当てはまらないということ。

つまり、彼女は冤罪だったのだ。

３０年代当時、アメリカはもっと建前社会だった。殺された二人は街の有力者の“庇護”をうけていた。そしてその有力者と彼女は不倫関係にあった。街の人間はその事実を知っていた。だがそれを公言するヤツなどいなかった。よくこの事件を同性愛の三角関係のもつれで、と説明されていることが多いが、真相はそんなに簡単なモノじゃない。彼女は行きがかり上仕方なく、愛人の有力者にある女性を紹介した。その女性はウィニー達が勤務するクリニックの患者で、梅毒病みだった。そのことを二人に知られ、愛人に「梅毒持ちを紹介した」と告げ口すると脅され喧嘩になる。（梅毒の特効薬が発見されるのは１０年もあとのことで、当時の梅毒は現在のエイズよりももっとおそれられた性病だった。罹患者を紹介することは関係の終了を意味した。）売り言葉に買い言葉で、二人が同性愛関係にあることを、自分たち三人が勤めている診療所に暴露する、と彼女が言った。それと放射線技師であるアンが診療所から一ヶ月間の自宅待機を命ぜられた際、放射線照射量をあげて、人体に危害が加わるようにしたことも。激高したアンがルースに銃を向け、サミーがアイロンで襲いかかる。格闘が続き、気がつくと二人が倒れていた。彼女は愛人である有力者に連絡する。
「あとは全てやっておく。また連絡する」
そのあと、彼女は鞄を持ってロスへ高飛びするよう愛人に命令され…、
あとは上に記した通りの結末となる。

彼女は「虎の女」と、ハースト流イエロージャーナリズムから洗礼名をつけられ、まだ捕まっていない段階にも関わらず、彼女が真相を激白したとする告白記事が連日紙面を踊った。当時ロスアンジェルスタイムスに殴り込みをかけたハースト、部数が伸び悩んでいたがその起爆剤として彼女は体よく利用されたようなものだ。（ハーストは彼女が上訴できるよう弁護士をつけ、その費用を負担した。功名心の塊には珍しく、彼はそれを公表しなかった。）警察もろくに裏をとってない情報を記者達に垂れ流した。スクープ合戦は加熱し、そこには被害者・加害者ともに人権なんてモノは存在してなかった。テレビはなく、ラジオも普及してない時代、嘘だろうが捏造だろうが、新聞に載ったことはまごうことなき「事実」だった。１９３０年代という暗い時代に、彼女は格好のネタを提供した状態だった。ちょうど、戦時中の世相にある種の明るさを提供した阿部定事件のように。
後年フェニックスの歴史家はこう記した。
「ウィニー・ルース・ジャド事件は大恐慌を忘れさせた」
警察が証拠を捜す前に、やじうまでぐしゃぐしゃにされた犯行現場。証言者は公然と圧力をかけられ、調査報告書などの公文書も提出されなかったり、書き換えられたりと、かなりいい加減な扱いを受ける。公正な裁判を経たとはとても言い難い有様だ。死体を解体したのは、有力者がよく、愛人や斡旋した女達の中絶をする時に使っていたとされる医師だったと言われる。（当時は中絶が非合法で、施術された方もした方も厳罰に処された。医者は金のために引き受けていたとはいえ、そのことでかえって有力者にいいように使われる存在となっていたらしい。）彼は「真相を告白する」と周囲に話し、彼女の弁護士を訪れる約束をした前日に、謎の死を遂げる。心臓麻痺、と公式見解にはあるが、右手にナイフを握ったままの死は公式見解とは別の意味を私に投げかける。
そして彼女が所持していたのは違う口径の弾丸が致命傷となったサミーの死体。
その意味も。

事件の後、愛人は事業に失敗し、養老院で死んだ。彼女を公正な裁判にかけなかった検事は州知事まで上り詰めたが、選挙で敗れ、職を失った。

ウィニー・ルース・ジャッドは今も生きているかもしれない。

お手本がそこにある状態だけれど、なにも学ばない日本。
正しい事という認識よりも、権力や感情で動く日本。。

nice!ありが㌧。ＣＢＳドキュメント（６０ﾐﾆｯﾂ）なんか見ていると、まだまだこういう冤罪って多いんだなと思いました。ただここまで大がかりなものはなかなか成立しずらいじゃないかと。実際この本を読んで、日本が学ぶべき点がいろいろと浮かんできます。勉強になりました。
